Please read these Terms and Conditions ("Terms") carefully before using our website or engaging Apex Shutters & Blinds for services.
1. Definitions
"Company", "We", "Us" refers to Apex Shutters & Blinds, operating in Essex, United Kingdom.
"Client", "You" refers to the person or entity engaging the Company for services.
"Goods", "Services" refers to the bespoke shutters, blinds, design, manufacture, and installation services provided by the Company.
2. Quotations and Orders
Quotations are valid for a period of 30 days from the date of issue. An order is deemed to be accepted only when the Company issues a written acknowledgement or invoice.
Due to the bespoke nature of our work, all orders are subject to a final technical survey to verify measurements and confirm specifications.
3. Payment Terms
Unless otherwise agreed in writing, deposits are required to secure your production slot and order materials. Further payments will be due prior to delivery and installation, with the final balance payable upon completion.
We reserve the right to suspend work if payments are not made by the agreed dates.
4. Bespoke Goods and Cancellations
Important: As our products are made to your exact specifications and clearly personalised, the right to cancel under the Consumer Contracts Regulations 2013 does not apply once the manufacturing process has begun.
All bespoke shutters and blinds are non-refundable once production has commenced.
If you wish to cancel an order before manufacturing has started, you may do so in writing, but we reserve the right to retain a portion of the deposit to cover costs already incurred (e.g., design work, surveys, materials ordered).
5. Delivery and Installation
We will endeavour to fulfil your order by the estimated delivery date set out in the acknowledgement of order. However, strict deadlines cannot be guaranteed due to the nature of bespoke manufacturing.
We will assume that the installation site is ready for us to work on the agreed dates. Any delays caused by the site not being ready may incur additional charges.
6. Warranty and Liability
We warrant that goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for a period of 10 years from installation.
This warranty does not cover fair wear and tear, wilful damage, negligence, abnormal working conditions, or damage caused by alterations made by third parties.
Our liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with any contract shall be limited to the total price of the goods and services supplied.
7. Installation Access
You must provide safe and reasonable access to the installation area. This includes ensuring the area is clear of furniture, decorations, and obstructions.
If additional work is required to prepare the installation site, this may be charged separately.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales.
